Homeowners Choice Property & Casualty Insurance Co. alleged to have breached contract

ORLANDO – Two consumers claim that their insurer failed to full amount of the losses to their property.

Wilmary Torres and Francisco Avila filed a complaint on April 13 in the 9th Orange County Circuit Court against Homeowners Choice Property & Casualty Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs allege that on Jan. 21, they suffered damages to their property that were caused by a covered peril under the policy. The suit states the defendant refused to pay the full amount of benefits that the plaintiffs are entitled to for the losses sustained. 

The plaintiffs request a trial by jury and seek judgment against defendant for damages, prejudgment interest, court costs, expert fees, attorneys’ fees, and further relief that the court deems just. They are represented by Dean Makris of Makris Law PA in New Port Richey.
