Skilled nursing facility owners accused of negligence after resident eloped, was struck by vehicle

ORLANDO – A couple has filed suit against a skilled nursing facility after the husband was struck by a vehicle when he left the facility.

Enrique and Eleida Ortiz filed a complaint on April 12 in the 9th Judicial Circuit Court of Florida - Orange County against the defendants alleging 15204 West Colonial Drive Operations LLC, doing business as Colonial Lakes Health Care; Epsilon Health Care Properties LLC; CMC II LLC; and  Lavie Care Centers LLC alleging negligence.

According to the complaint, Enrique Ortiz was a resident of the defendants' Colonial Lakes Health Care in Winter Garden. The suit states that on July 30, 2016, Enrique Ortiz suffered a headache, scalp hematoma, lacerations and other injuries from being struck by a vehicle when he eloped from defendant's facility as a result of the negligence of the nursing staff to properly monitor the condition and whereabouts of plaintiff. 

The plaintiffs hold 15204 West Colonial Drive Operations LLC, doing business as Colonial  Lakes Health Care; Epsilon Health Care Properties LLC; CMC II LLC; and Lavie Care Centers LLC responsible because the defendants allegedly failed to provide the necessary care and services to maintain or improve plaintiff’s well-being and failed to properly train staff on how to supervise residents.

The plaintiffs request a trial by jury and seek judgment against defendants, for damages, plus costs, interest, and further relief as the court deems just. They are represented by Garry J. Rhoden of Colling Gilbert Wright & Carter LLC in Orlando.
