Patient alleges medical providers' negligence caused delay of cancer treatment

ORLANDO – A woman alleges her diagnosis of breast cancer was delayed because of the negligence of her medical providers.

Tammie McLaren-Smith and Jerome Smith filed a complaint on April 6 in the 9th Judicial Circuit Court of Florida - Orange County against Robert Posniak MD, Osceola Radiology Associates PA and Sand Lake Imaging LLP alleging negligence, loss of consortium and other counts.

According to the complaint, the plaintiffs allege that McLaren-Smith was referred to Posniak for mammography and interpretations in May 2013. The plaintiffs hold Posniak, Osceola Radiology Associates PA and Sand Lake Imaging LLP responsible because the defendants allegedly failed to timely, appropriately and accurately interpret plaintiff's laboratory results and recommend additional diagnostic studies, and failed to warn plaintiff of the risks of her true condition and delay in treatment. She alleges that her diagnosis of breast cancer was delayed as a result. Smith alleges he has suffered the loss of consortium of his wife.

The plaintiffs seek judgment for damages against the defendants for compensatory damages, costs and other relief as the court deems just. They are represented by John W. Dill of Morgan & Morgan PA in Orlando.
