Consumers file claim against insurer over alleged water damage to property

FORT LAUDERDALE – A couple alleges their insurer breached its contract by failing to pay for their claim.

Eric and Fraida Lakien filed a complaint on March 30 in the 17th Judicial Circuit Court of Florida - Broward County against Universal Property & Casualty Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs allege that on March 4, their insured Coconut Creek property was damaged by water and that they reported the loss to the defendant. The suit states the plaintiffs and defendant disagree as to the facts regarding the cause and value of the loss. The plaintiffs hold Universal Property & Casualty Insurance Co. responsible because the defendant allegedly breached its contract with plaintiff by failing to fulfill its obligations under the policy.

The plaintiffs request a trial by jury and seek judgment against defendant for general damages, including interest, attorney's fees, costs, and other relief deemed just. They are represented by Charles H. Bechert III of Bechert & Associates in Pompano Beach.
