Consumer claims water damage to home should be covered by People's Trust Insurance Co.

FORT LAUDERDALE – A Miramar property owner alleges her residence suffered property damage and her insurance failed to provide coverage for it.

Vanessa Jackson filed a complaint on March 30 in the Broward Circuit Court against People's Trust Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on July 31, 2016, her property, while insured under the defendant, suffered a covered loss as a result of water damage from a roof leak. Although, the suit states that the defendant did investigate on the cause of loss, it wrongfully denied coverage with the reason that the loss was not covered under the policy. The plaintiff holds People's Trust Insurance Co. responsible because the defendant allegedly failed to acknowledge coverage for the loss, and failed to make any payment of insurance proceeds to plaintiff.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, interest, court costs, attorney's fees and further relief as the court deems just. She is represented by David Low of David Low & Associates PA in Fort Lauderdale.
