ORLANDO – Former bartenders for an Orange County business allege it improperly utilized the tip credit.

Timothy Virdi and Kaitlyn Wilson filed a complaint individually and on behalf of all others similarly situated on April 5 in the Orange County Circuit Court against Levy World Limited Partnership, doing business as Portobello Yacht Club, citing the Florida Minimum Wage Act.

According to the complaint, the plaintiffs allege that they suffered loss of earnings from defendant's wrongful conduct of applying tip credit to every hour that the plaintiffs worked. They allege they were not able to keep all the tips they earned as they were required to include in the tip pool the morning bartenders who are not regularly and customarily tipped out and are not working in the same shift. 

The plaintiffs hold Levy World Limited Partnership responsible because the defendant allegedly utilized the tip credit and unjustly benefited by saving the tip credit amount for each hour plaintiffs worked.

The plaintiffs request a trial by jury and seek judgment in favor of plaintiffs, liquidated damages, damages for all unpaid wages, interest, attorneys’ fees, costs, disbursements and further relief as the court deems just.
