Disabled patron alleges DEJ Hotels LLC does not have accessible restrooms

FORT LAUDERDALE – A Palm Beach County man alleges a Fort Lauderdale business has barriers that restrict access to the disabled.

Howard Cohan filed a complaint on April 6 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale against DEJ Hotels LLC, doing business as Galleryone - A Doubletree, alleging that the real property operator failed to comply with the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he visited defendant's premises on March 31, 2016, and Nov. 16, 2016, but was denied full and equal access to the facility. The plaintiff holds DEJ Hotels LLC responsible because the defendant allegedly has discriminated against plaintiff by failing to provide accessible restrooms, accessible seating at the bar at the pool and has other barriers at the property.

The plaintiff seeks an order requiring defendant to alter its facilities to make it accessible to and usable by individuals with disabilities, attorney’s fees, all costs and such other and further relief as the court may deem necessary. He is represented by Gregory S. Sconzo of Kaplan Sconzo & Parker PA in Palm Beach Gardens.
