FORT LAUDERDALE – A couple alleges their insurance company did not cover water damages to their property.
Carol and Larry Valentine filed a complaint on March 28 in the 17th Judicial Circuit Court of Florida - Broward County against Citizens Property Insurance Corp. alleging breach of contract.
According to the complaint, the plaintiffs allege that on Nov. 1, 2016, they suffered damages to their Miramar property because of water. However, the defendant allegedly denied coverage for their claim, despite the plaintiffs purchasing an "all-risk" policy that covers all physical losses. The plaintiffs hold Citizens Property Insurance Corp. responsible because the defendant allegedly failed to pay the amount of damages sustained by plaintiffs.
The plaintiffs request a trial by jury and seek judgment against defendant for damages, plus interest, costs and attorney's fees. They are represented by Joshua Whisler of The Whisler Law Firm PA in Boca Raton.
