Flogrown claims Dixie Heritage is selling counterfeit clothing using its mark

MIAMI – An Orlando apparel company alleges a retail company is selling counterfeit versions of its clothing.

Flogrown LLC filed a complaint on March 31 in the U.S. District Court for the Southern District of Florida against Dixie Heritage LLC, Asher Torgeman and Albert Tourgemen alleging trademark infringement.

According to the complaint, the plaintiff alleges that its Flogrown mark was used without its authorization. The plaintiff holds Dixie Heritage LLC, Torgeman and Tourgemen responsible because the defendants allegedly manufactured and sold counterfeit apparel that were unauthorized reproductions of plaintiff's products.

The plaintiff requests a trial by jury and seeks judgment against defendants, damages, profits from infringement, costs of action, treble damages, punitive damages of $100,000 or an amount the court may deem just, and additional relief as the court deems proper.
