Individual alleges he is owed money from sale of coffee companies

FORT LAUDERDALE – A Broward County man alleges he was not paid proceeds promised from the sale of two companies.

Joseph Lopez filed a complaint on March 23 in the 17th Judicial Circuit Court of Florida - Broward Circuit against San Giorgio Coffee Inc., Hollywood Gourmet Coffee Inc. and Joseph DeCaria alleging breach of contract.

According to the complaint, the plaintiff alleges that in 1999, he formed a coffee business with DeCaria on equal sharing. When the business failed after the 2011 terrorist attack, DeCaria promised 12 percent of shares from his other defendant businesses, but failed to deliver on his contractual promise by not paying the promised percentage of the net proceeds and profits from sale of the businesses, the suit states.

The plaintiff holds San Giorgio Coffee Inc., Hollywood Gourmet Coffee Inc. and DeCaria responsible because the defendants allegedly failed to fulfill their obligations under the agreement by failing to pay the contractual promise of 12 percent profit from stocks and 12 percent net proceed from the sales of both companies.

The plaintiff requests a trial by jury and seeks judgment for damages against defendants, interest, costs, and other relief to which he may be entitled. He is represented by Hank Jackson and Sean M. Smith of Shutts & Bowen LLP in West Palm Beach.
