MyRaceRagz accused of unlawfully using photographer's work

TAMPA – A South Carolina photographer alleges a Clearwater apparel company used one of his photographs without authorization.

Jason Bennett filed a complaint on April 6 in the U.S. District Court for the Middle District of Florida against Flavor Races LLC, doing business as MyRaceRagz, alleging copyright infringement.

According to the complaint, the plaintiff alleges that he is the owner of a photograph taken in 2011 titled "Run for the Yorktown-217." The plaintiff holds Flavor Races LLC responsible because the defendant allegedly copied the plaintiff's photograph without permission to use for advertising and promoting its business.

The plaintiff requests a trial by jury and seeks judgment against defendant, enjoinder from further violation, actual damages and profits, statutory damages, attorneys’ fees, costs of suit, and further relief as the court deems just. He is represented by Joel B. Rothman and Kevin E. Cudlipp of Schneider Rothman Intellectual Property Law Group PLLC in Boca Raton.
