Former We Care Recycling Administration employee alleges he was wrongfully terminated

TAMPA – A man alleges he was unlawfully terminated from a Polk County business after he tried to return to his job after taking a medical leave.

Richard Scott filed a complaint on April 7 in the Tampa Division of the Middle District of Florida against We Care Recycling Administration LLC alleging violation of the Family and Medical Leave Act and the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he took FMLA leave from December 2016 to March 2017 for a neck surgery. The suit states that when he provided the defendant with the appropriate medical documents to return to work, the defendant refused to return his job. He alleges the defendant told him that he could not return to work unless he signed a full Health Insurance Portability and Accountability Act release to give the defendant full access to his medical records. The suit states he was eventually terminated.

The plaintiff requests a trial by jury and seeks judgment for damages against the defendant, together with back pay, front pay, reinstatement, interest, liquidated damages, costs, attorney's fees and other relief permitted by law.
