MIAMI – A visually impaired man alleges he is unable to access the Sally Beauty Holdings website.

Andres Gomez filed a complaint on April 3 in the U.S. District Court for the Southern District of Florida against Sally Beauty Holdings Inc. citing the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he was denied access and/or the ability to utilize defendant's website and/or understand the content therein because it does not interface with and is not readable by screen-reader software.

The plaintiff holds Sally Beauty Holdings Inc. responsible because the defendant allegedly failed to provide an ADA button or link on its website to adjust the format so it would be able to be read by the software and failed to interface the website with the software.

The plaintiff requests a trial by jury and seeks declaratory judgment that determines defendant's violation of the ADA, attorney’s fees, costs, litigation expenses, and all other remedies available that the court deems just. He is represented by Jeannette E. Albo of Thomas B. Bacon PA in Miami and Thomas B. Bacon of Thomas B. Bacon PA in Mt. Dora, Florida.
