ORLANDO – A Sarasota County man alleges he was injured because of a sandbag at Hollywood Studios.

Roger and Christine Gay filed a complaint on March 20 in the 9th Judicial Circuit Court of Florida - Orange County against Walt Disney Parks and Resorts US Inc. alleging negligence.

According to the complaint, on May 22, 2015, Roger Gay was an invitee at the Backlot Express at Hollywood Studios. He alleges he was injured when he stepped back to allow a person to exit and tripped over a sandbag and foot of a temporary wall. He alleges he suffered severe permanent bodily injuries, disability, mental anguish, loss of earnings and incurred medical expenses as a result. Additionally, Christine Gay alleges she has lost the comfort, society, protections and companionship of her husband.

The plaintiffs hold Walt Disney Parks and Resorts US Inc. responsible because the defendant allegedly failed to provide a safe, unobstructed ingress and egress to the restroom, and failed to take actions to reduce, minimize, or eliminate foreseeable risks.

The plaintiff requests a trial by jury and seeks judgment in their favor against defendant, compensatory damages, plus interest and costs, and further relief as the court deems just. They are represented by John M. Murray and Jennifer M. Clark of Murray, Morin & Herman PA in Tampa.
