Man alleges he is still entitled to disability benefits from Prudential Insurance Co.

TAMPA – A former employee of Teco Energy alleges his disability benefits were wrongfully terminated.

Thomas Heywood filed a complaint on April 7 in the Tampa Division of the Middle District of Florida against The Prudential Insurance Co. of America alleging that the claims administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff was approved for disability benefits in 2014 and has failed and refused to pay the benefits since August 2016. The plaintiff alleges that as a result of defendant's termination of his disability benefits, he has suffered monetary damages of no less than $39,756.17. The plaintiff holds The Prudential Insurance Co. of America responsible because the defendant allegedly failed and refused to pay the benefits sought by plaintiff since Aug. 18, 2016.

The plaintiff seeks an order declaring that plaintiff is entitled to long-term disability benefits from Aug. 18, 2016, through the filing of this complaint, plus interest, attorney's fees, costs and such further relief as the court deems just and proper. He is represented by John V. Tucker and Amy Ray of Tucker & Ludin PA in St. Petersburg.
