TAMPA – A New York woman alleges a debt collector unlawfully had her wages garnished.

Krystal Pulsifer, formerly known as Krystal Turco, filed a complaint on April 7 in the Tampa Division of the Middle District of Florida against Noam J. Cohen PA and Noam J. Cohen alleging that they willfully violated the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff's wages garnished for the payment of a student loan debt as the result of a judgment filed by the defendants. She alleges that she qualifies as head of family and that her wages are exempt from garnishment under state law. The suit states that state law also required the defendants to notify the plaintiff of this exemption, but the defendants sent the notice to her former address and she did not receive it.

The plaintiff holds Noam J. Cohen PA and Noam J. Cohen responsible because the defendants allegedly falsely represented the character, amount or legal status of her alleged debt and mailed the notice of garnishment at her old address.

The plaintiff requests a trial by jury and seeks damages, attorney’s fees, litigation expenses, costs of suit and such other or further relief as the court deems proper. She is represented by James S. Giardina and Kimberly H. Wochholz of The Consumer Rights Law Group PLLC in Tampa.
