Broward County man sues Citizens Property for invalidly denying coverage

FORT LAUDERDALE — A Broward County resident is suing Citizens Property Insurance Corporation, alleging the insurer wrongly denied his claim.

David Palmer filed a complaint on March 14 in the Broward County Circuit Court claiming that the insurer denied an obviously valid claim without sufficient cause.

According to the complaint, the plaintiff alleges that he has suffered economic damages as a result of defendant's denial of coverage for his damaged property, under an insurance policy that should cover sustained damages, necessary repairs and replacement, as well as cleaning and other remedial measures. The plaintiff holds Citizens Property Insurance responsible because it allegedly failed to establish it had reasonable proof that it was not responsible for the payment of plaintiff's damaged property and failed to pay the requested amounts for repair and replacement.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, interest, attorney's fees, costs and other relief that the court deems just. He is represented by Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
