Level 3 Communications files suit after Salser Construction damaged cables

OCALA — A telecommunications company is suing Salser Construction, Inc. formerly known as Salser Utility Services, Inc. for alleged negligence during employment resulting to damage to other business.

Level 3 Communications, LLC filed a complaint on April 6, in the U.S. District Court for the Middle District of Florida Ocala Division against Salser Construction, Inc. f/k/a Salser Utility Services, Inc. alleging that the defendant failed to exercise due care at all times to not cause any harm to other business.

According to the complaint, the plaintiff alleges that, in July 29, 2013, plaintiff's cable and accompanying conduits were damaged due to underground water pipe work. The cable and accompanying conduits were cut with a handsaw resulting to temporary lost of telecommunication services to numerous customers. 

The plaintiff allege defendant failed to plan its water pipe work to avoid damaging the cable and accompanying conduits and failed to adhere to applicable statutes, regulations and industry standards to avoid damaging underground finer-otic cables and conduits.

The plaintiff requests a trial by jury and seeks judgment in the amount of $75,000, costs of this action, pre and post-judgmengg interest, and such other relief as this Court deem just and proper. They are represented by David J. Lisko of Holland and Knight, LLP in Tampa.
