Man says People's Trust incorrectly denied insurance claims for home damage

FORT LAUDERDALE — A homeowner is suing People's Trust Insurance Company, citing alleged breach of contract for failing to honor the plaintiff's claims regarding his Hollywood home.

Ahmed Kabir filed a complaint on March 14 in the Broward County Circuit Court against People's Trust alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that he suffered damages as a result of defendant's denial of benefits claimed by plaintiff for repair and replacement of his residential roofing system, personal property destroyed and alternative living arrangement expense for uninhabitable property, covered by an insurance policy with the defendant in full force and effect. The plaintiff holds People's Trust responsible because it allegedly failed to provide a reasonable explanation of the basis in the insurance policy for its denial of coverage and failed to timely evaluate and pay the benefits owed to plaintiff.

The plaintiff requests a trial by jury and seeks judgment against the defendant, declaratory relief, actual damages, interest, attorney's fees, costs and further relief deemed just. He is represented by Joseph Goldglantz of Gold Litigation PA in Hallandale Beach.
