FORT PIERCE – A Monroe County resident alleges that a property owner failed to provide full and safe equal access to its facilities.

Francis Martinez filed a complaint on April 3 in the U.S. District Court for the Southern District of Florida, Fort Pierce Division against Seacoast Self-Storage Inc., doing business as Seacoast Self Storage, alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he suffered discrimination, injury and damage from being denied the benefits of services, programs and activities of the defendant’s buildings and its facilities. The plaintiff holds Seacoast Self-Storage Inc. responsible because the defendant's property allegedly does not have an accessible restroom.

The plaintiff seeks judgment against defendant, declaratory relief, alter the premises, award attorneys' fees, costs, expert fees, other expenses, and further relief as it may seem just. He is represented by Jason S. Weiss of Weiss Law Group PA in Coral Springs.
