Property owners alleged to have failed to let tenant retrieve equipment

ORLANDO – Two landlords are accused of unlawfully retaining a former tenant's equipment.

Yong Ling Ma, as receiver/trustee of MM Group USA Inc., filed a complaint on March 23 in the 9th Judicial Circuit Court of Florida - Orange County against In Ho Park and Chong Soon Park alleging trespass to chattel, unjust enrichment, common law action for conversion and other counts.

According to the complaint, the plaintiff entered into a lease agreement with the defendant for property in Apopka for use as a mushroom farm in 2012. The suit states that the plaintiff vacated the property when the lease expired in December 2014, but the defendants refuse to let the plaintiff retrieve its equipment.

The plaintiff holds In Ho Park and Chong Soon Park responsible because the defendants allegedly refused to allow plaintiff or its representative to retrieve its equipment, detained plaintiff’s equipment and property in reckless disregard of its rights, and ignored all communications sent by plaintiff in its attempt to retrieve its properties.

The plaintiff requests a trial by jury and seeks judgment against the defendants; general, special, punitive and compensatory damages; plus the costs of action; attorneys’ fees; and further relief as the court may deem proper. The plaintiff is represented by Xiao Bing Xu in Orlando.
