Disabled man alleges Pembroke Pines gas station does not have compliant restroom

Disabled person accuses MNV Energy North Perry LLC d/b/a Chevron Gas Station of disability discrimination

FORT LAUDERDALE — A disabled person is suing MNV Energy North Perry LLC d/b/a Chevron Gas Station, a property owner, citing alleged disability discrimination.

Howard Cohan filed a complaint on March 31, in the U.S. District Court for the Southern District of Florida against MNV Energy North Perry LLC d/b/a Chevron Gas Station alleging that the property owner failed to provide full and safe equal access to its facilities.

According to the complaint, the plaintiff alleges that, he has suffered discrimination, injury and damage from being denied full and equal access and enjoyment of the services, programs, goods, amenities and activities being offered at defendant's property, because of the illegal architectural barriers situated therein. The plaintiff holds MNV Energy North Perry LLC d/b/a Chevron Gas Station responsible because the defendant allegedly created hazards to plaintiff's safety and well-being, interfered with plaintiff's right to travel free of discrimination, and failed to design and construct ADA-compliant premises.

The plaintiff requests a trial by jury and seeks judgment against defendant, injunctive and declaratory relief, award attorneys' fees, all costs, other expenses of suit, and further relief as it may deem just.
