Lam International claims Marketing Arm International is unlawfully using Lynx mark

MIAMI – A Montana agricultural products business alleges its trademark is being unlawfully used.

Lam International Corp. filed a complaint on April 3 in the U.S. District Court for the Southern District of Florida against Marketing Arm International Inc. alleging trademark infringement.

According to the complaint, the plaintiff alleges that it has suffered injury to its business as a result of defendant's advertising of products for sale under the "Lynx" designation, which is confusingly similar to plaintiff's federally registered Lynx mark, without the license or consent of the plaintiff. 

The plaintiff holds Marketing Arm International Inc. responsible because the defendant allegedly caused confusion among consumers by offering products and using the same marks as plaintiff's distinctive marks.

The plaintiff seeks judgment in its favor, enjoinder from further violation, account and pay plaintiff all profits realized from infringement, exemplary and/or punitive damages, attorney's fees and costs of suit. It is represented by Nancy J. Flint of Nancy J. Flint PA in Plantation.
