Former Oceans 234 employees allege they are owed unpaid minimum wages

MIAMI – Former employees of a Deerfield Beach restaurant have filed a class action over allegations of unpaid wages.

Richard Magee, Andrew Carofano and Amanda Fletcher filed a complaint on behalf of themselves and others similarly situated on April 3 in the U.S. District Court for the Southern District of Florida against Epic Restaurant Group Inc., doing business as Oceans 234 and formerly known as Maxwell's By The Sea Inc.; and Danielle Rosse, formerly and  also known as Danielle Williams, citing the Fair Labor Standards Act and the Florida Minimum Wage Amendment.

According to the complaint, the plaintiffs allege that they and other similarly situated employees allege they were not paid a minimum wage during their employment.

The plaintiffs hold Epic Restaurant Group Inc. and Rosse responsible because the defendants allegedly failed to pay the plaintiffs for meetings and mandatory training, unlawfully used the tip credit, and failed to keep accurate time and pay records regarding all the hours worked by the plaintiffs.

The plaintiffs request a trial by jury and seek designation of representatives and class counsel, unpaid minimum wages, liquidated and compensatory damages, attorney's fees and costs, interest, and further relief as the court deems just. They are represented by Samara Robbins Bober and Peter J. Bober of Bober & Bober PA in Hollywood.
