Woman alleges Holiday Inn Express location has insufficient number of compliant parking spaces

ORLANDO – A disabled person alleges a Holiday Inn Express in Volusia County is not compliant with the Americans with Disabilities Act.

Patricia Kennedy filed a complaint on April 3 in the U.S. District Court for the Middle District of Florida against Balajio LLC alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that she suffered frustration and humiliation because of the discriminatory conditions at the defendant's facility. The plaintiff holds Balajio LLC responsible because the defendant's property allegedly has an insufficient number of compliant parking spaces and an insufficient number of designated, accessible rooms.

The plaintiff seeks judgment against defendant, injunctive relief, attorney's fees, costs, litigation expenses, and further relief as the court deems just. She is represented by Thomas B. Bacon of Thomas B. Bacon PA in Fort Lauderdale.
