Achristavest Pier 6600 LLC alleges 3030 Bayshore Properties' Ikona mark is similar to Icona

MIAMI – A Fort Lauderdale hotel owner is accused of unlawfully using the Ikona mark for advertising.

Achristavest Pier 6600 LLC filed a complaint on March 29 in the U.S. District Court for the Southern District of Florida against 3030 Bayshore Properties LLC alleging trademark infringement.

According to the complaint, the plaintiff alleges that it has suffered injury to its business and reputation from defendant's use of Icona trademarks. The plaintiff holds 3030 Bayshore Properties LLC responsible because the defendant allegedly could create consumer confusion with the use of the similar Ikona mark.

The plaintiff seeks judgment against defendant, the transfer of any registration of the infringing mark, remove all signs bearing the infringing mark, award of profits, treble damages, costs, attorneys’ fees, disbursements, and other relief that the court finds just. It is represented by Jeffrey McFadden, Philip Foret and David Fitzgibbon of Stradley Ronon Stevens & Young LLP in Washington, D.C.
