Former Miami Beach Medical Group employee alleges he was not paid for some overtime hours

MIAMI – A Miami-Dade County man alleges he was not compensated for some overtime work by a medical clinic operator.

Ernesto Hidalgo Diaz filed a complaint on March 29 in the U.S. District Court for the Southern District of Florida against the Miami Beach Medical Transport LLC and Rodolfo Dumenigo MD PA, doing business as Miami Beach Medical Group, alleging that they willfully violated the overtime provisions of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Nov. 11, 2016, and March 13, 2017, he worked approximately 60 hours per week for defendants without receiving overtime wages at a rate of time-and-one-half times his regular rate. The plaintiff holds Miami Beach Medical Transport LLC and Rodolfo Dumenigo MD PA responsible because the defendants allegedly failed to pay the plaintiff for time spent calling patients and for lunch breaks he did not take.

The plaintiff requests a trial by jury and seeks recover all damages, interest and all other relief which the court deems reasonable. He is represented by Daniel T. Feld of Law Office of Daniel T. Feld PA in Hollywood and Isaac Mamane of Mamane Law LLC in Miami.
