Consumer claims NPAS Solutions has the wrong number

MIAMI – A Lantana man alleges a Tennessee debt collector keeps contacting him to reach an unknown person.

Charles T. Johnson filed a complaint on behalf of himself and others similarly situated on March 28 in the U.S. District Court for the Southern District of Florida against NPAS Solutions LLC alleging that the debt collector violated the Telephone Consumer Protection Act and Fair Debt Collection Practices Act.

According to the complaint, the plaintiffs allege that the defendant keeps calling in an attempt to collect on an alleged debt from an unknown third party. He alleges the calls were made using an automatic telephone dialing system or a prerecorded voice and without any prior express consent to call plaintiff. The plaintiffs hold NPAS Solutions LLC responsible because the defendant allegedly continued to call plaintiffs after being informed that it had the wrong contact number and contacted plaintiff without prior express consent.

The plaintiff requests a trial by jury and seeks judgment against defendant, determine proper class action, statutory damages of $1,500 per violation, costs, expenses, attorneys' fees, expert fees and further relief as the court may deem just.
