Consulting Support Services accused of interfering with former employee's FMLA rights

TAMPA – A woman alleges she was retaliated against by her former employer for taking a medical leave.

Dorothy Lehner filed a complaint on March 20 in the Tampa Division of the Middle District of Florida against Consulting Support Services LLC alleging that the former employer violated the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that in November 2016, two days after she returned to work from an FMLA-protected medical leave, her position had been filled and she was not restored to the position she had held before her leave. The plaintiff holds Consulting Support Services LLC responsible because the defendant allegedly interfered with her rights by denying job restoration and offered her a position that would pay $20,000 less per year.

The plaintiff requests a trial by jury and seeks compensation for back wages and benefits, liquidated damages, attorney’s fees, costs and such other and further relief. She is represented by Craig L. Berman of Berman Law Firm PA in St. Petersburg.
