FORT LAUDERDALE – A man has filed a class action suit against two Broward County businesses over allegations he was misclassified as an independent contractor.

Marquis Coleman filed a complaint on behalf of and other similarly-situated individuals on March 21 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against the Oakland Car Service Inc., Annellie's Car Wash LLC, Jacob Schneider and Rene L. Moreno citing the Fair Labor Standards Act.

According to the complaint, the plaintiff worked for the defendants from 2001 to 2016 as a nonexempt tipped car wash employee. He alleges he worked for 50 to 60 hours per week. The plaintiff holds Oakland Car Service Inc., Annellie's Car Wash LLC, Schneider and Moreno responsible because the defendants allegedly failed to keep or provide an accurate record of its employees' hours worked, misclassified him as an independent contractor, failed to compensate its employees of overtime wages and failed to pay a minimum wage.

The plaintiffs request a trial by jury and seek judgment against defendants, declaratory relief, compensatory damages and an equal amount of liquidated damages, attorney's fees, costs and expenses. He is represented by Zandro E. Palma of Zandro E. Palma PA in Miami.
