Las Pavas Cafeteria alleged to have barriers that restrict access to disabled patrons

MIAMI – A Miami man alleges a Miami restaurant and property owner have failed to make the property accessible to disabled patrons.

Daniel Lopez filed a complaint on March 21 in the U.S. District Court for the Southern District of Florida against Las Pavas Cafeteria Corp. and GMAC Property Investments Inc. alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that the defendants' property has architectural barriers that prevent persons with disabilities like plaintiff to fully and equally access its facilities and premises and avail of the services and goods offered within the property. The plaintiff holds Las Pavas Cafeteria Corp. and GMAC Property Investments Inc. responsible because the defendants allegedly failed to comply with the requirements of the ADA.

The plaintiff requests a trial by jury and seeks judgment against defendants, an order to remove the physical barriers and alter the facility, attorney's fees, expert fees, costs and litigation expenses. He is represented by Lauren Wassenberg of Law Office of Lauren Wassenberg in Boca Raton.
