Phone 07

ORLANDO – A Kissimmee resident alleges a debt collector has called him hundreds of times and continued to call after he revoked his consent.

Joshua Watson filed a complaint on March 21 in the U.S. District Court for the Middle District of Florida, Orlando Division against Credit One Bank NA alleging that the creditor violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that the defendant began calling him in October 2016 to collect an alleged debt and that he has requested twice for the calls to stop. The suit states he has received 400 calls from the defendant and that the calls have invaded his privacy. The plaintiff holds Credit One Bank NA responsible because the defendant allegedly contacted plaintiff without prior express consent and unlawfully utilized an automatic dialer and automated voice.

The plaintiff requests a trial by jury and seeks judgment against defendant; statutory, treble, punitive and actual damages; costs; interest; attorney's fees; enjoinder from further violations; and other such relief the court may deem just. He is represented by Shaughn C. Hill of Morgan & Morgan PA in Tampa.
