Circle K did not pay overtime wages, former sales clerk claims

TAMPA – A former gas station sales clerk alleges she was not properly compensated for overtime work.

Ivey Smith filed a complaint on March 21 in the U.S. District Court for the Middle District of Florida against Circle K Stores Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she worked for the defendant from May 2015 to January 2017 as a sales clerk. The plaintiff holds Circle K Stores Inc. responsible because the defendant allegedly failed to pay the plaintiff overtime at a rate of time-and-one-half of her regular rate.

The plaintiff requests a trial by jury and seeks judgment against defendant for unpaid overtime compensation, liquidated damages, attorneys' fees, costs incurred, declaratory relief, and further relief that the court determines to be just. She is represented by Matthew R. Gunter of Morgan & Morgan PA in Orlando.
