Prudential Insurance alleged to have wrongfully terminated disability benefits

MIAMI – A woman claims her disability benefits were wrongfully terminated.

Vickie L. Reasner filed a complaint on March 20 in the U.S. District Court for the Southern District of Florida against The Prudential Insurance Co. of America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she has been disabled since May 2015 and that she applied for disability benefits with the defendant. The suit states these benefits were approved and paid through April 2016, when they were terminated. The plaintiff holds The Prudential Insurance Co. of America responsible because the defendant allegedly failed to provide a prompt and reasonable explanation of the basis relied upon its decision, and failed to adequately describe to plaintiff any additional material or information necessary to perfect her claim.

The plaintiff seeks judgment against defendant, reinstatement to the plan, payment of disability benefits, costs, attorneys’ fees, interest, and further relief as the court deems just. She is represented by Alexander A. Palamara and Gregory Michael Dell of Attorneys Dell and Schaefer Chartered in Hollywood.
