Disabled person alleges 2601 Collins LLC has barriers that restrict his ability to access business

MIAMI – A disabled Miami man claims his access to a Miami Beach business was limited or denied because of barriers that exist there.

Daniel Lopez filed a complaint on March 17 in the U.S. District Court for the Southern District of Florida against Alejandro Nerguizian, Christian Nerguizian and 2601 Collins LLC alleging violations of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he suffered from legal harm and injury due to the architectural barriers that exists in the property owned by the defendants. The plaintiff holds Alejandro Nerguizian, Christian Nerguizian and 2601 Collins LLC responsible because the defendants' property allegedly has an inaccessible dining counter, exterior service windows, restrooms and other issues.

The plaintiff seeks judgment against defendants, injunction against further discriminatory practices, close the facility until alterations are completed, attorney’s fees, expert fees, costs and litigation expenses. He is represented by Lauren Wassenberg in Boca Raton.
