Woman seeks disability benefits from Liberty Life Assurance Co. of Boston

MIAMI – A former employee of Baptist Health System alleges her claim for disability benefits was unlawfully denied.

Lori Swindall filed a complaint on March 17 in the U.S. District Court for the Southern District of Florida against Liberty Life Assurance Co. of Boston citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she became disabled in June 2015 and that her claim for disability benefits has been denied. The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly failed to adequately describe to plaintiff any additional material or information necessary to perfect her claim, and failed to provide a prompt and reasonable explanation of the basis relied upon for the denial of benefits.

The plaintiff seeks judgment against defendant, disability benefits due, attorneys' fees, interest, and further relief as the court deems just. She is represented by Victor Peña and Gregory Michael Dell of Attorneys Dell and Schaefer Chartered in Hollywood.
