MIAMI – A legally blind man alleges that a sandwich shop franchise isn't compatible with screen reader software.

Andres Gomez filed a complaint on March 17 in the U.S. District Court for the Southern District of Florida, Miami Division against Jersey Mike's Franchise Systems Inc., doing business as www.jerseymikes.com, citing the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that the defendant's website has barriers that prevent him from using screen reader software to access the website. He alleges that because of this, he is unable to communicate with the defendant to access information about restaurant locations. The plaintiff holds Jersey Mike's Franchise Systems Inc. responsible because the defendant's website allegedly denies full and equal access to it.

The plaintiff requests a trial by jury and seeks judgment against defendant, require the defendant to remove barriers from its website, display the universal disabled logo, injunctive and equitable relief, expenses, attorney's fees, interest, compensatory damages, and further relief as it deems necessary. He is represented by Scott R. Dinin of Scott R. Dinin PA in Miami.
