FORT PIERCE – A Palm Beach County woman alleges a Stuart business is not accessible to persons with disabilities.

Janet Hoyt filed a complaint on March 17 in the U.S. District Court for the Southern District of Florida against Florida Backyard Store LLC, doing business as Fortunoff Backyard Store, alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that she has suffered from discrimination and injury due to the architectural barriers that exists in the property owned by the defendant. The plaintiff holds Florida Backyard Store LLC, doing business as Fortunoff Backyard Store, responsible because the defendant allegedly failed to design and construct such premises to be accessible to and accommodate persons with disabilities.

The plaintiff requests a trial by jury and seeks an order for the defendant to alter its premises, attorneys' fees, court costs, expert fees, and further relief as it may deem just. She is represented by Jason S. Weiss and Zachary W. Smith of Weiss Law Group PA in Coral Springs.
