Woman alleges Unum Life wrongfully terminated short-term disability benefits

PENSACOLA – An Escambia County individual formerly employed by CVS alleges both of her claims for disability benefits were unlawfully denied.

Debbie L. Sanders filed a complaint on March 17 in the U.S. District Court for the Northern District of Florida, Pensacola Division against Unum Life Insurance Co. of America alleging that the claims administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she applied for short-term disability benefits in April 2015 and for long-term disability benefits in December 2015. She alleges the short-term disability benefits were approved then later terminated that September and the long-term benefits claim was denied.

The plaintiff holds Unum Life Insurance Co. of America responsible because the defendant's decisions allegedly were arbitrary and capricious.

The plaintiff seeks prejudgment interest, attorney’s fees, costs of action and all other relief deemed just. She is represented by Nick A. Ortiz of Ortiz Law Firm in Pensacola.
