Man alleges Hartford Life wrongfully terminated disability benefits

PENSACOLA – A New York man alleges his disability benefits were wrongfully terminated.

Gary Skwarlo filed a complaint on March 17 in the U.S. District Court for the Northern District of Florida, Pensacola Division against Hartford Life and Accident Insurance Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he became disabled due to hypertension, hyperlipidemia, anxiety, dyspnea, headaches, dizziness, fatigue and other impairments in 2014 and that his claim for disability benefits was approved. The suit states his disability benefits were terminated in August 2016. The plaintiff holds Hartford Life and Accident Insurance Co. responsible because the plaintiff alleges he is still disabled as defined by the plan.

The plaintiff requests a trial by jury and seeks judgment against the defendant for all plan benefits owing, prejudgment interest, attorney’s fees, costs of action, and all other relief deemed just. He is represented by Nick A. Ortiz of Ortiz Law Firm in Pensacola.
