Disabled man alleges Arby's restaurant has inaccessible barriers

TAMPA – A Pasco County man who uses a wheelchair alleges a fast food restaurant in Lutz has discriminatory barriers.

Qaisar Khan filed a complaint on March 17 in the Tampa Division of the Middle District of Florida against JLD Realty Inc. alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he visited the defendant's Arby's restaurant and had difficulties accessing the goods and services there because of architectural barriers. The plaintiff holds JLD Realty Inc. responsible because the defendant's property allegedly has an inaccessible curb ramp, drink counters and other barriers.

The plaintiff requests a trial by jury and seeks judgment against defendant, injunctive and declaratory relief, attorney's fees, costs, expenses of suit, and further relief as deemed just. He is represented by Louis I. Mussman and Brian T. Ku of Ku & Mussman PA in Pembroke Pines.
