Guardian Life Insurance Co. of America alleged to have wrongfully denied benefits

PENSACOLA – A surgeon alleges his claim for disability benefits was wrongfully denied.

William E. Smith Jr. MD filed a complaint on March 15 in the U.S. District Court for the Northern District of Florida against Guardian Life Insurance Co. of America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he became disabled in December 2014 and applied for disability benefits, which were denied in August 2015. The plaintiff holds Guardian Life Insurance Co. of America responsible because the defendant's denial was allegedly not based on a deliberate, principled reasoning process.

The plaintiff requests a trial by jury and seeks judgment in his favor, payment of long-term disability benefits, interest, attorney's fees, costs, and all damages that the court deems appropriate. He is represented by Keith W. Weidner of Taylor, Warren & Weidner PA in Pensacola.
