Santander Consumer USA Inc. accused of harassing couple with collection calls

OCALA –  Two Marion County consumers claim a debt collector has called them more than 200 times.

Sherryl Cates-Aquino and Luis Aquino filed a complaint on March 13 in the U.S. District Court for the Middle District of Florida against Santander Consumer USA Inc. alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiffs allege that since May 2016, they have suffered damages from receiving several collection calls from the defendant. The plaintiffs holds Santander Consumer USA Inc. responsible because the defendant allegedly kept on calling the plaintiffs despite their requests to stop calling and harassed them with the frequency of the calls.

The plaintiffs request a trial by jury and seek statutory damages, punitive damages, actual damages, all legal fees, interest, and any other relief as the court deems just. They are represented by Octavio "Tav" Gomez of Morgan & Morgan Tampa PA in Tampa.
