Woman formerly employed by Arby's location alleges she is owed unpaid overtime wages

FORT LAUDERDALE – A former employee for a fast food restaurant in Vero Beach alleges she was only paid straight time for overtime work and has filed a class action.

Tamara Dalbey filed a complaint on behalf of others similarly situated on March 13 in the U.S. District Court for the Southern District of Florida against T.T.K.M. Inc., doing business as Arby's, and Thomas Lureau citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she was employed by the defendants from March 2014 to February 2017. The plaintiff holds T.T.K.M. Inc., doing business as Arby's, and Lureau responsible because the defendants allegedly failed to pay overtime premiums to the plaintiff at a rate of time-and-one-half of her regular rate of pay.

The plaintiff requests a trial by jury and seeks unpaid overtime wages, liquidated damages, all legal fees, interest, and any other relief as this court deems just. She is represented by Keith M. Stern and Hazel Solis Rojas of Law Office of Keith M. Stern P.A. in Miami.
