Man claims Atrium Medical Corp. device caused injuries

DELAND – A patient alleges he was injured by a medical device used to repair hernias.

Joseph A. Godwin filed a complaint on March 2 in the 7th Judicial Circuit Court of Florida - Volusia County against Atrium Medical Corp. alleging negligent manufacture and strict liability in the manufacture.

According to the complaint, the plaintiff alleges that on April 9, 2013, he a surgery that attempted to repair hernias using the defendant's C-Qur hernia mesh. He alleges the unsafe product caused him injury. The plaintiff holds Atrium Medical Corp. responsible because the defendant allegedly failed to use reasonable care in the manufacture and distribution of an unsafe product and failed to properly manufacture the product.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages, costs and interest. He is represented by Jonathan I. Rotstein of Law Offices of Rotstein & Shiffman LLP in Daytona Beach.
