Lincoln National Life Insurance Co. alleged to have wrongfully denied disability benefit claim

MIAMI – A Miami resident alleges her claim for disability benefits was wrongfully denied.

Vivian Diaz filed a complaint on March 7 in the U.S. District Court for the Southern District of Florida, Miami Division against The Lincoln National Life Insurance Co., as successor in interest to Jefferson Pilot Financial Insurance Co., citing the Employee Retirement Income Security Act.

According to the complaint, in 2014, the plaintiff became disabled and applied for long-term disability benefits. The plaintiff holds The Lincoln National Life Insurance Co., as successor in interest to Jefferson Pilot Financial Insurance Co., responsible because the defendant allegedly denied the plaintiff's claim without justification.

The plaintiff seeks full and complete reimbursement of all long term disability benefits, reinstatement, all legal fees and any other relief as the court deems just. The plaintiff is represented by Andrew B. Sapiro of Law Offices of Andrew B. Sapiro PA in Miami.
