Towing America LLC alleged to owe driver overtime wages

TAMPA – A tow truck driver for a Pinellas County company alleges he was not properly compensated for overtime work.

Jason Omelia filed a complaint on behalf of himself and others similarly situated on Feb. 24 in the Tampa Division of the Middle District of Florida against Towing America LLC, doing business as Jimmies Towing and Recovery, and Shannon Anderson citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he routinely worked more than 80 hours per week during his employment with the defendants. The plaintiffs hold Towing America LLC, doing business as Jimmies Towing and Recovery, and Anderson responsible because the defendants allegedly failed to pay plaintiff at a rate of time-and-one-half for overtime compensation and failed to pay minimum wage.

The plaintiffs request a trial by jury and seek judgment against defendants, payment of all overtime hours, liquidated damages, attorneys' fees, costs, and further relief that the court deems just. He is represented by Marc R. Edelman of Morgan & Morgan PA in Tampa.
