Policy holder alleges Liberty Life took away disability benefits

MIAMI – A Florida insurance plan participant is suing Liberty Life, alleging his benefits were wrongfully terminated.

Jeffrey Judkins filed a complaint Feb. 23 in the U.S. District Court for the Southern District of Florida against Liberty Life Assurance Co. of Boston, alleging violation of the Employee Retirement Income Security Act.

According to the complaint, in 2014, Judkins, an employee of Smith & Nephew Inc., became disabled and was initially paid benefits until they were terminated in 2016. The plaintiff alleges Liberty Life wrongfully terminated his disability benefits when he is entitled to them and failed to properly and adequately investigate the plaintiff's claim.

Judkins seeks payment of disability benefits due, immediate reinstatement, all legal fees, interest and all other relief the court deems just. He is represented by attorney Stephen F. Jessup of Attorneys Dell and Schaefer, Chartered in Hollywood.
