MIAMI – A Dade County man formerly employed as a sous chef claims he was not paid properly for overtime work.
C. Paula filed a complaint on behalf of all others similarly situated
on March 1 in the U.S. District Court for the Southern District of
La Cucina Management Inc., doing business as Perricone's Marketplace
& Cafe, and Steven Perricone
alleging violation of the Fair Labor Standards Act.
the complaint, the plaintiff alleges that he worked as a sous chef for
the defendants from 2008 to 2017. The plaintiff holds La Cucina
Management Inc., doing business as Perricone's Marketplace & Cafe,
and Perricone responsible because the defendants allegedly failed to
compensate the plaintiff for working more than 40 hours per week at the legal
rate of one-and-one-half his regular rate of pay.
requests a trial by jury and seeks double damages, all overtime wages
still owing, all legal fees and any other relief as the court deems
