Former employee claims Oriluz Windows Corp. did not pay overtime premiums

MIAMI – A Dade County business is alleged to have not paid overtime compensation to a former employee.

Alexi A. Hernandez Andreu filed a complaint on behalf of all others similarly situated on Feb. 28 in the U.S. District Court for the Southern District of Florida against Oriluz Windows Corp. and Javier Perez alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff worked for the defendants from October 2015 to February and claims he worked an average of 60 hours per week. The plaintiff holds Oriluz Windows Corp. and Perez responsible because the defendants allegedly failed to pay the plaintiff any overtime premiums of one-and-one-half his regular rate of pay for hours worked that exceeded 40 hours per week. He also alleges that he was injured on the job and that the defendants did not carry worker's compensation insurance to cover the plaintiff's expenses.

The plaintiff requests a trial by jury and seeks damages and any other relief as the court deems just. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
